6215 EMPLOYMENT OF RELATIVES/NEPOTISM

Statement of Policy

In order to ensure the best possible education for our students, it is the policy of this Board to employ the most qualified available personnel. In furtherance of this policy, the Board recognizes the importance of recruitment and employment techniques, which will ensure that open positions are made known to interested persons, that equal employment opportunity laws are carefully followed, and that conflicts of interest are avoided. The Board recognizes that conflicts can occur where persons are employed who are related to Board trustees or to District employees, particularly those in administrative and supervisory positions. This policy will define limitations and expectations relating to the employment of relatives. It is the policy of this board that such relatives be neither disadvantaged nor provided with a preference in employment, except that certain employment may be limited or prohibited where there is an actual or perceived conflict of interest.

Relatives Defined

For the purpose of this policy, a relative of a Board trustee or a current school district employee shall include any person related by bloodline or legal process (including marriage). It shall include the following relationships: child, grandchild, sibling, parent, grandparent, niece and nephew, as well as any of the foregoing relationships that are based on marriage (“in-law” status) or the familial relationship of step-child, step-parent, etc.

Relatives of Board of Education Trustees, Administrators and Supervisors

A relative of a trustee of the Board of Education, an administrator or supervisor may be employed only after approval by at least 2/3 of the trustees of the Board of Education.

A relative of a Board of Education trustee may not be employed, promoted, transferred or assigned to any position for which the Board would be the first or second level supervisor for the relative.

Relatives of Administrators and Supervisors

A relative of an administrator or supervisor may not be employed, promoted, transferred or assigned to any position for which the administrator/supervisor would be the first or second level supervisor for the relative. A first level supervisor is one to whom an employee reports directly. A second level supervisor is one to whom the employee’s direct supervisor reports.

Other Relatives

Persons who are related to each other may be employed by the District, as long as it is not in a supervisory relationship prohibited under section 4 above. However, the Board, upon the recommendation of the Superintendent, may transfer one of two related employees who work under the same first level administrator/supervisor if a potential or actual conflict arises.

Employment of Students and Other Summer/Seasonal Employees

The District will make the availability of student summer work known to students via announcements, local circuit television, district website, etc. A preference for summer and/or seasonal employment will be provided to residents of the District, as permitted under civil Service Law. Students who are relatives of Board trustees or District employees may be employed in summer/seasonal positions, subject to the guidelines set forth in paragraph 3, 4, and 5 above. In order to provide opportunities to a maximum number of students, there shall be no presumption that a student who has been employed by the District will be rehired for the next summer/season.

Notice

The Board of Education shall be provided with at least fourteen days prior written notice whenever the appointment of a relative is being recommended by the administration (including appointments to temporary and substitute positions).

Effective Date and Exemptions

This policy shall become effective on July 1, 2007. It shall only apply to employment relationships occurring after the effective date of this policy, and it shall not apply to current employees who become relatives after the date of this policy or to future employees who become relatives after they become employed (unless the relationship is anticipated at the time of application for employment, e.g. engaged to be married). Notwithstanding the foregoing, the Board reserves the right to transfer related employees who are exempted under this section but would otherwise be employed in a prohibited position, upon the recommendation of the Superintendent of Schools, in order to avoid an actual or potential conflict. In cases of a transfer, including transfers under section 5, the less senior employee will be transferred, except where the less senior employee is in a supervisory/administrative position, or where the less senior employee provides critical services for the District.
